This policy describes how SkyOp LLC ("SkyOp", "Company" or "We") may collect, use, share, retain and protect your Personal Information through our educational services on our learning platform (the "Services"). We provide Services both to students enrolled in educational institutions ("Schools") through the Schools and directly to other customers who enroll in our programs on an independent basis. This privacy policy applies to your Personal Information, which can include any information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you, your house, or your device ("Personal Information"). Any Personal Information or other records regarding a student at a School that purchases our Services is further defined for the purposes of this policy as Student Data ("Student Data"). Student Data may include educational records governed by the Federal Educational Rights and Privacy Act ("FERPA"). We consider Student Data confidential and will only use it to provide our Services as set forth herein, subject to applicable law.
Please read this policy carefully. This policy may change from time to time (see "Changes to Our Privacy Policy"). Your continued use of the Services after we make changes is deemed to be an acceptance of those changes, so please check the policy periodically for updates.

2. Information our Privacy Policy Covers
This privacy policy applies to Personal Information SkyOp obtains in various contexts, both online and offline, including:
- Through the Services, and
- In email, text, and other electronic messages between you or your School, if applicable, and the Company.
It does not apply to information collected by:
- Us offline or through any other means, other than listed above, including on any other website operated by Company or any third party.
- Our Services may provide links to websites and/or applications operated and maintained by third parties. We have no control over the privacy practices of websites or applications we do not own and encourage you to review all third party privacy policies carefully.
3. Our Policy on Children's Privacy
We do not knowingly collect any information from children under the age of 13 in the United States unless and until the relevant School or parent for direct to customer programs, has provided consent and authorization for a child under 13 to use the Services and for us to collect information from such person. Where a School or parent instructs us to collect personal information from children under the age of 13, we collect, use, process and retain such information solely to provide the Services on behalf of the School or parent and for the purposes set forth in our agreement with the School or our terms and conditions under which the parent purchased our Service. We collect only as much information as is necessary to provide the Service and the School or parent may access, delete, or withdraw consent for continued processing of the child's information at any time. If you have any questions about reviewing, modifying, or deleting Personal Information of a child under the age of 13, please contact your School directly, or if you purchased the Services directly from us, please contact us at support@skyop.com.
Please contact us at support@skyop.com if you believe we have inadvertently collected Personal Information from a child under 13 without proper consent. This will allow us to delete such information as soon as possible.
To the extent the Children's Online Privacy Protection Act (COPPA) (15 U.S.C. 6501 et seq.) applies to the information we collect, for Services purchased through a School, we process such information for educational purposes only, at the direction of the School and on the basis of educational institutional consent. For Services purchased by parents for direct to customer programs, we will not collect or process Personal Information of a child under the age of 13 until parental consent and authorization has been collected.
4. Information We Collect / Notice at Collection
The Personal Information that we collect from you depends on how you interact with our Services. The following table lists the categories of Personal Information and the specific pieces of Personal Information we have collected within the last twelve (12) months. The table also lists, for each category our business use and whether we share the information with third parties. We do not sell your Personal Information or use it for targeted marketing. Please see "How We Collect Your Personal Information", "How We Use Your Personal Information", and "How We Disclose Your Personal Information" for more detailed information.
Typically, we retain your Personal Information for the period necessary to fulfill the purposes outlined in this privacy policy, unless a longer retention period is required or permitted by law. Student Data is deleted within sixty (60) days after the end of the school year, which we define as June 30th of each year. Personal Information for our classes sold directly to customers is typically kept for eighteen months after the end of the applicable course. We maintain teacher information and teacher accounts to associate them with their next class or course unless we have been advised to delete them. Our service providers retain backups of our learning platform data, which may include your Personal Information, for up to one year before deletion. Please note that in certain cases we must retain all, or a portion, of your Personal Information to comply with our legal obligations, resolve disputes, or enforce our agreements.

5. How We Collect your Personal Information
We collect Personal Information about you from various sources, including:
- Directly from you, such as:
- Information that you provide by filling in forms on our Services. This includes information provided at the time of creating an account for our Services, purchasing our Services, posting material, or requesting further services. We may also ask you for information when you report a problem with our Services.
- Records and copies of your correspondence (including email addresses), if you contact us. Some of our Services have feedback functionality that collects limited information about your device, the Services, and your School such as your user ID when you provide feedback.
- Your search queries on the Services.
- Student and teacher work product. You may provide information on non-public areas of the Services in connection with course work, student or teacher contributions or discussions tests or quizzes. We consider this to be Student Data. We further consider Student Data to include Personal Information or materials created by the student or their parent that is 1) provided to SkyOp by the student or parent, 2) provided by an employee or agent of the School to SkyOp, or 3) gathered by SkyOp through operation of the Services. If you are a teacher, we also collect information about your grading, feedback, and assessments, and similar actions within our Services.
- Teachers also may provide information to be published or displayed (hereinafter, "posted") on our “instructor collaboration” forum which is visible to other teachers who are users of our Services (collectively, "User Contributions"). Teacher's User Contributions are posted on and transmitted to other users at their own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Services with whom teachers may choose to share User Contributions. Therefore, we cannot and do not guarantee that teacher's User Contributions will not be viewed by unauthorized persons. User Contributions are not Student Data and will not be held confidential.
- From your School, such as:
- Information about you needed to set up and maintain your account or for us to be able to provide the Services, such as your name, email address, student ID, account credentials, and courses you are enrolled in when we initially set up the Services for your School. We will receive regular updated information to keep your account information accurate and up to date.
- When you or your School contacts us for support, we may collect limited information about you that you or a representative of your School provides to us. We use this information only to assist with client support cases on behalf of your School.
- Automatically, when you navigate through the Services, open or click on emails we send you, such as:
- Usage details, IP addresses, and information collected through cookies, web beacons, clear GIF, pixels, internet tags, web server logs and other data collection tools. For more information, please see "Automatic Data Collection Technologies" below.
6. Automatic Data Collection Technologies
As you interact with our Services, we use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns.
The technologies we use for this automatic data collection may include:
- Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Services. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Services.
- Web Beacons. Pages of our Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics.
7. How We Use your Personal Information
We may use or disclose the Personal Information we collect for one or more of the following purposes:
- Providing Our Services. We use Personal Information to provide our Services and its content to you in furtherance of the course purpose taught through the Services, including to provide, personalize, support, and develop our Services. We may use Personal Information to allow you to participate in the interactive features of our Services, to notify you about changes to our Services and any products or services we offer through it.
- Educational uses. We use Personal Information to allow you to interact with the course material. All student and teacher information provided by you (other than User Contributions publicly posted by teachers) will be treated as Student Data and is shared with the applicable School, including to the extent applicable names, grades, identifying information, student work, quizzes, tests, question and answers, and any student or teacher submissions (other than User Contributions). We only use Student Data for the purpose that you or the applicable School provided it which is to obtain the applicable course through our Services. We use the information in accordance with our agreement with your School to operate, maintain, and provide the features and functionality of the Services. Your School determines how your Student Data is used.
- Communicating with You. We use Personal Information to provide you with support and to respond to your inquiries, including to investigate and address your concerns, follow up on your issues and feedback, monitor and improve our responses, and to provide customer service.
- Research and Development of Educational Products. We use Personal Information for testing, research, analysis, and educational product and services development, including to develop and improve our Services, as required or allowed by state or federal law.
- Law Enforcement. We use Personal Information to ensure legal and regulatory compliance. We use Personal Information to respond to law enforcement requests as required by applicable law, court order, or governmental regulations. We also use such information to comply with any court order, law, or legal process, including to respond to any government or regulatory request.
- Business Transfers. We may share Personal Information with another company to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about our Services users is among the assets transferred.
8. How We Disclose Your Personal Information
We do not rent or sell any Personal Information to third parties, use Personal Information for marketing purposes, or claim ownership of Personal Information.
We will not engage in targeted advertising on our Services or any other website, service, or application when the targeting of the advertising is based upon any information, including Personal Information, that we have acquired because of your use of our Services. We will not use Personal Information created or gathered from our Services to amass a profile about a student enrolled in a School, except in furtherance of School purposes. We will not sell a student's Personal Information, except in instances of a business transfer further explained in this policy.
In addition to the specific situations already mentioned in this privacy policy, we disclose Personal Information in the following circumstances:
- SkyOp Team. We use Student Data in furtherance of the School purpose of the Services. Student Data will be accessed only by those who have a need to know to provide the Services to your School and improve them. For instance, our technical team and client support team may have access to your Student Data when we set up the Services for your School or when software or database changes are required for support and maintenance.
- To Schools. All Student Data is kept confidential and shared with only our service providers and the applicable School teaching the applicable course. We may be permitted or required by state or federal law to share information with a state or local educational agency, including schools of local educational agencies, for K-12 school purposes. What information is shared depends on the product functionality, settings, and instructions of your School. Please contact your School to learn more.
- Service Providers. We share certain Personal Information with third parties that perform services to support our core business functions and internal operations including: hosting our Services, providing customer support, including by e-mails and text messages, and to perform analytics. A current list of these service providers is available upon request at support@skyop.com. We only make these business purpose disclosures under written contracts that require the service provider to implement and maintain reasonable security procedures and practices and prohibit the service provider from using or sharing Student Data or Personal Information for marketing purposes.
- Legal Process. If federal or state law requires us to disclose Personal Information or Student Data, we must comply with the requirements of the law in protecting and disclosing that information. We may disclose Personal Information in response to subpoenas, warrants, court orders, government inquiries or investigations. We may also disclose information to establish, exercise, or protect the rights of our company, employees, agents, and affiliates; to defend against a legal claim; and to take action regarding possible illegal activities or violations of our policies.
- Business Transfers. We may share Personal Information with another company that buys some, or all, of the assets or equity in SkyOp and that company may use and disclose Personal Information for purposes similar to what is described in this policy. SkyOp may also share Personal Information with prospective purchasers to evaluate the proposed transaction.
- Public forums. Some of our Services provide the opportunity to post content in a public forum. For example, teachers can post content on message boards to one another within their course and to other teachers across Schools through the “instructor collaboration” forum. Please be aware if you decide to submit information in the instructor collaboration forum, that information will be publicly available in limited circumstances and will not be considered Personal Information.
9. How We Protect your Personal Information
We have implemented administrative, physical, and technical safeguards designed to protect your Personal Information. However, it should be noted that no system is fail safe. Personal Information is stored on servers within the United States.
The safety and security of your Personal Information also depends on you. Where we have given you (or where you have chosen) a password for access to our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Services like message boards between teachers of different Schools. The information you share in public areas may be viewed by other teachers using the Services.
10. Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:
- Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Services may then be inaccessible or not function properly. We do not use tracking technologies for advertising or marketing purposes, such as targeted advertising.
11. Accessing and Correcting Your Information
If you are over 18 and have purchased the Services directly, you can review and change your Personal Information by logging into the Services and visiting your account profile page. If you are under 18 and your parent purchased the Services directly, your parent can review and change your Personal Information by logging into the Services and visiting your account profile page. You may also send us an email at support@skyop.com to request to access, correct or delete any Personal Information that you have provided to us.
If you are a School who has purchased the Services, you can review and change portions of your students' Student Data by logging into the Services. You may also send us an email at support@skyop.com to request to access, correct or delete any Personal Information or Student Data that you have provided to us.
If you are a user or a parent of a user of our Services that we provide on behalf of your School, contact your School to exercise your rights. We are obligated under FERPA to remain under the direct control of your School with respect to our use and maintenance of student Personal Information that is part of the Student Data. As such, if you use SkyOp through a school account and wish to exercise your rights in respect to student Personal Information, please contact your School, and we will work with them to facilitate your request.
If you are a parent or guardian of a former student, or a former student who is 18 years of age or older, who has not been enrolled in the School for at least the last 60 days, you may send us an email at support@skyop.com to request to access, correct or delete any Personal Information or Student Data under our control that you have provided to us.
Please note that due to the applicable laws, all requests related to Student Data will be subject to additional verification measures and require valid consent in writing. We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
If you delete your User Contributions from the Services, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Services users.
12. Changes to Our Privacy Policy
It is our policy to post any changes we make to our privacy policy on this page with a notice that the privacy policy has been updated on the Services home page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for periodically visiting our privacy policy to check for any changes.

14. International Transfer of Personal Information
Please note that these Services are directed towards users who reside in the United States. By using these Services, you consent to the collection, storage, processing, and transfer of Personal Information in and to the United States, or other countries and territories, pursuant to the laws of the United States.
